MySoCal Terms of Use Agreement

 

This legal agreement ("Agreement") between you and MySoCal.com ("MySoCal") sets out the legally binding terms for your membership, use of the Web site ("Website") and other services available from MySoCal.com.


MySoCal.com is owned and operated by PartyKarma, Inc. Use of MySoCal.com is subject to all applicable MySoCal policies, including but not limited to Membership Rules, Billing Rules, Privacy Policy.

This Agreement and other MySoCal policies may be modified from time to time, such modifications are effective upon posting on MySoCal Web site.

You must read and accept all terms and conditions before you complete your membership registration and gain access to the services of MySoCal.

1. Eligibility

You must be at least 18 years old or over to register with MySoCal Web site and to use any services provided by MySoCal. Individuals under the age of 18, but at least 13 years of age, may use the MySoCal Service only under the supervision of a parent or legal guardian who agrees to be bound by this Agreement. MySoCal Service is not intended for anyone under the age of 13.

 

Membership in the Service is void where prohibited. By using this Web site, you represent and warrant that you have the right, authority, and capacity to enter into this Agreement and to abide by all of the terms and conditions of this Agreement.

2. Term
This Agreement will remain in full force and effect while you use MySoCal Web site. Either you or MySoCal may terminate your use of the Web site and/or services at any time, for any reason, without explanation, effective upon sending written notice to the other party. MySoCal reserves the right to immediately suspend or terminate your access to the Services, without notice, upon any breach of this Agreement by you which is brought to our attention. In the event your access to the Service is suspended due to the breach of this Agreement, you agree that all fees then paid to the MySoCal by you shall be nonrefundable. Even after this Agreement is terminated, certain provisions will remain in effect.

3. Legal and Acceptable conduct
Your use of the MySoCal Website and Services is subject to all applicable local, state, national and international laws and regulations.

The following is a partial list of conduct that is illegal and prohibited at MySoCal:

MySoCal reserves the right to investigate and take appropriate legal action in its sole discretion against anyone who violates this provision. Offending communication is subject to removal from the Service, the membership of such violators is subject to immediate termination.

 

4. Membership

Once you.ve completed registration process you become a member of MySoCal. By default each member receives Basic membership which gives them access to the Site and Services. For more information on choices of membership and rules please see Membership Rules (link here).

 

5. Privacy
Use of the Website and Services is governed by the Privacy Policy, which may be viewed by

6. Security
You are responsible for maintaining the confidentiality of your password and account as well as any and all activities that occur under your account. You must promptly inform MySoCal of actual or apparent breaches of security, such as loss, theft, or an authorized disclosure or use of your account or password. Until we are notified by email of a breach in security, you will remain liable for any unauthorized use of the MySoCal Service through your account.


7. Disclaimers of no warranties
You expressly agree that your use of MySoCal is at your sole risk. MySoCal Service is provided on "AS IS" and "AS AVAILABLE" basis. All WARRANTIES OF ANY KIND whether express or implied are EXPRESSLY DISCLAIMED.
MySoCal does not warrant that your use of the Service will be secure, uninterrupted, always available, error-free or will meet your requirements, or that any defects in the Service will be corrected. MySoCal DISCLAIMS LIABILITY FOR, AND NO WARRANTY IS MADE WITH RESPECT TO, THE CONNECTIVITY AND AVAILABILITY OF THE SERVICE.

MySoCal does not guarantee the accuracy, completeness or usefulness of any information on the Service. MySoCal does not endorse nor accepts responsibility for the accuracy or reliability of any opinion or statement made by any party other then the Company. MySoCal will not be responsible for any loss or damage, including personal injury or death, resulting from anyone.s reliance on content posted on the service or transmitted between registered users. MySoCal will not be responsible for safety, comfort, successful travel arrangements of its members and/or other liability related to the use of Website.

MySoCal makes NO GUARANTEES, either express or implied, regarding the conduct of its Members or Registered Users. MySoCal makes NO GUARANTEES nor promises of any specific results from your use of the Website and/or Service.

8. Disputes
You are solely responsible for your interactions with other Members and Registered Users and agree to take normal precautions when dealing with individuals through the Service. MySoCal reserves the right, but has no obligation, to monitor disputes between you and other Members/Registered Users.

If there is any dispute about or involving the Website and/or the Service, by using the Website, you agree that the dispute will be governed by the laws of the State of California without regard to its conflict of law provisions. You agree to personal jurisdiction by and venue in the state and federal courts of the State of California, City of Los Angeles.

9. Indemnity
You agree to indemnify and hold MySoCal, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any losses, liability, claims, or demands, including reasonable attorney's fees, due to or arising out of your use of the Service in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth above and/or violation of any federal, state or local law or regulation.

10. Proprietary Rights
MySoCal owns and retains proprietary rights in the Website and Service. The Service contains copyrighted material, trademarks, and other proprietary information of MySoCal, its licensors and licensees. In addition, other Registered Users /Members may post copyrighted information, which has copyright protection whether or not it is identified as copyrighted. Except for that information which is in the public domain or for which you have been given permission, you agree not to copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information.

By posting information or content to any public area of the MySoCal, you automatically grant, and you represent and warrant that you have the right to grant, to MySoCal and its Registered Users an irrevocable, perpetual, non-exclusive, fully-paid, worldwide license to use, copy, publicly perform, publicly display and distribute such information and content and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sub-licenses of the foregoing.
